Workers Comp Basics

This is NOT a complete review of Oregon workers comp, just some very basic information you MUST know to be able to survive the system.

Why do I need a lawyer?

The insurance company is NOT in the business of paying claims; it is in the business of figuring out ways how to not pay claims. Simply put, the insurance company is NOT on your side.

When should I see my doctor?

You MUST see your doctor on a regular basis, no matter what, even if your claim is denied. Do not stop seeing the doctor until the doctor tells you to stop.

  1. Time loss is ONLY paid if it is authorized in writing by your doctor and that authorization must be regularly renewed.
  2. Only your doctor can take you off work and only your doctor can authorize treatment or medication.
  3. Only your doctor can authorize closure of your claim no matter what an IME doctor says. If your claim is closed it is because your doctor ok’d it.
How do I keep up to date on my case?

You MUST keep me informed of ALL your contact information, including mailing address, phone number and email address. If I cannot reach you, I cannot protect your interests because only you can make decisions.

If I have a lawyer, can I ignore mail from insurance?

You MUST read the mail you get from the insurer because Oregon law requires them to tell you what they are doing, what your rights are AND what your responsibilities are.

  1. If you get a letter telling you that you must fill out a form or turn in some records, then you MUST do so or your claim can be suspended.
  2. If you get a letter telling you that you must attend an examination, then you MUST attend it, or your claim can be suspended.
  3. Call me if you do not understand something you get in the mail.
Should I quit my job?

Do NOT quit your job and do not give your employer an excuse to terminate you. If you do, you may lose the right to BOTH time loss AND unemployment.
